This is because central to the effectiveness of any regional human rights organ is access, and compliance of decisions by State Parties.<\/p>\n<p>The African Court was established to complement the protective mandate of the African Commission on Human and Peoples\u2019 Rights (the Banjul Commission) by strengthening the human rights protection system in Africa and ensuring respect for and compliance with the African Charter on Human and Peoples\u2019 Rights, as well as other international human rights instruments through judicial decisions. The African Court which is the judicial arm of the African Union (AU) was established by virtue of Article 1 of the Protocol to the African Charter on Human and Peoples\u2019 Rights on the Establishment of an African Court on Human and Peoples\u2019 Rights (the Court Protocol). It was adopted on 9 June 1998 in Ouagadougou, Burkina Faso, and entered into force on 25 January 2004. The Court started its operations in the year 2006 in Arusha, Tanzania where it has its permanent seat.<\/p>\n<p>Twenty years after the adoption of the Court Protocol, a significant number of African citizens are still not able to access the African Court directly due to a very low number of countries that have deposited Article 34(6) Declaration of the Court Protocol to allow direct access to the African Court for individuals and Non-Government Organizations (NGOs) with observer status before the Banjul Commission. Out of the 34 countries that have ratified the Court Protocol, only eight countries have deposited Article 34(6) declaration, these are; Burkina Faso, Ghana, Guinea Bissau, The Gambia, Mali, Malawi, Niger and Tunisia. And in the span of four years between 2016 and 2020, four (4) States withdrew from Article 34(6) declaration, limiting direct access to the African Court for individuals and NGOs, these are; Rwanda, Tanzania, Benin and Cote d&rsquo;Ivoire. This poses a great challenge to the mandate of the African Court and makes it increasingly challenging for victims of human rights violations to access justice and seek reparations when they are not satisfied with local remedies. Although indirect access to the African Court for NGOs exists through referrals of cases from the Banjul Commission to the African Court, such avenue has been limited in scope and efficacy.<\/p>\n<p>Nevertheless, compliance with the decisions of the African Court by State Parties is another key challenge that not only affects the effectiveness of the Court, but also victims of human rights violations from obtaining reparations. En effet, l&rsquo;efficacit\u00e9 de tout organe r\u00e9gional de d\u00e9fense des droits humains repose sur l&rsquo;acc\u00e8s et sur le respect de ses d\u00e9cisions par les \u00c9tats membres.<\/p>\n<p>La Cour africaine a \u00e9t\u00e9 cr\u00e9\u00e9e pour compl\u00e9ter le mandat de protection de la Commission africaine des droits de l&rsquo;homme et des peuples (Commission de Banjul) en renfor\u00e7ant le syst\u00e8me de protection des droits de l&rsquo;homme en Afrique et en veillant au respect et au respect de la Charte africaine des droits de l\u2019homme et des peuples, ainsi que d&rsquo;autres instruments internationaux relatifs aux droits humains, par le biais de d\u00e9cisions judiciaires. La Cour africaine, qui est l&rsquo;organe judiciaire de l&rsquo;Union africaine (UA), a \u00e9t\u00e9 cr\u00e9\u00e9e en vertu de l&rsquo;article 1 du Protocole \u00e0 la Charte africaine des droits de l&rsquo;homme et des peuples portant cr\u00e9ation d&rsquo;une Cour africaine des droits de l&rsquo;homme et des peuples (le Protocole de la Cour). Il a \u00e9t\u00e9 adopt\u00e9 le 9 juin 1998 \u00e0 Ouagadougou, Burkina Faso, et entr\u00e9 en vigueur le 25 janvier 2004. La Cour a commenc\u00e9 ses activit\u00e9s en 2006 \u00e0 Arusha, en Tanzanie, o\u00f9 elle a son si\u00e8ge permanent.<\/p>\n<p>Vingt ans apr\u00e8s l&rsquo;adoption du Protocole \u00e0 la cour, un grand nombre de citoyens africains ne peuvent toujours pas acc\u00e9der directement \u00e0 la Cour africaine en raison du tr\u00e8s faible nombre de pays qui ont d\u00e9pos\u00e9 la d\u00e9claration de l&rsquo;article 34(6) du Protocole pour permettre l&rsquo;acc\u00e8s direct \u00e0 la Cour africaine pour les individus et les organisations non gouvernementales (ONG) ayant le statut d&rsquo;observateur aupr\u00e8s de la Commission de Banjul. Sur les 34 pays qui ont ratifi\u00e9 le Protocole de la Cour, seuls huit pays ont d\u00e9pos\u00e9 la d\u00e9claration de l&rsquo;article 34(6) (il s&rsquo;agit du Burkina Faso, du Ghana, de la Guin\u00e9e-Bissau, de la Gambie, du Mali, du Malawi, du Niger et de la Tunisie). Et en l&rsquo;espace de quatre ans entre 2016 et 2020, quatre (4) \u00c9tats se sont retir\u00e9s de la d\u00e9claration de l&rsquo;article 34(6), limitant l&rsquo;acc\u00e8s direct \u00e0 la Cour africaine pour les particuliers et les ONG. Il s&rsquo;agit du Rwanda, de la Tanzanie, du B\u00e9nin et de la C\u00f4te d&rsquo;Ivoire. Cela repr\u00e9sente un grand d\u00e9fi pour le mandat de la Cour africaine et rend de plus en plus difficile pour les victimes de violations des droits de la personne d\u2019avoir acc\u00e8s \u00e0 la justice et d\u2019obtenir r\u00e9paration lorsqu\u2019elles ne sont pas satisfaites des recours locaux. Bien que l&rsquo;acc\u00e8s indirect \u00e0 la Cour africaine pour les ONG existe par le biais du renvoi d&rsquo;affaires de la Commission de Banjul \u00e0 la Cour africaine, cette voie a \u00e9t\u00e9 limit\u00e9e dans sa port\u00e9e et son efficacit\u00e9.<\/p>\n<p>N\u00e9anmoins, le respect des d\u00e9cisions de la Cour africaine par les \u00c9tats parties est un autre d\u00e9fi majeur qui affecte non seulement l&rsquo;efficacit\u00e9 de la Cour, mais aussi les victimes de violations des droits humains pour obtenir des r\u00e9parations. Isto porque o acesso e o cumprimento das decis\u00f5es por parte dos Estados Partes s\u00e3o fundamentais para a efic\u00e1cia de qualquer \u00f3rg\u00e3o regional de direitos humanos.<\/p>\n<p>O Tribunal Africano foi criado para complementar a fun\u00e7\u00e3o de protec\u00e7\u00e3o da Comiss\u00e3o Africana dos Direitos Humanos e dos Povos (Comiss\u00e3o de Banjul), refor\u00e7ando o sistema de protec\u00e7\u00e3o dos direitos humanos em \u00c1frica e assegurando o respeito e o cumprimento da Carta Africana dos Direitos Humanos e dos Povos, bem como de outros instrumentos internacionais de direitos humanos, atrav\u00e9s de decis\u00f5es judiciais. O Tribunal Africano, que \u00e9 o bra\u00e7o judicial da Uni\u00e3o Africana (UA), foi criado por for\u00e7a do artigo 1\u00ba do Protocolo \u00e0 Carta Africana dos Direitos Humanos e dos Povos relativo \u00e0 cria\u00e7\u00e3o de um Tribunal Africano dos Direitos Humanos e dos Povos (Protocolo do Tribunal). O mesmo foi adoptado em 9 de Junho de 1998 em Ouagadougou, Burkina Faso, e entrou em vigor em 25 de Janeiro de 2004. O Tribunal iniciou as suas actividades em 2006 em Arusha, na Tanz\u00e2nia, onde tem a sua sede permanente.<\/p>\n<p>Vinte anos ap\u00f3s a adop\u00e7\u00e3o do Protocolo do Tribunal, um n\u00famero significativo de cidad\u00e3os africanos ainda n\u00e3o tem acesso directo ao Tribunal Africano devido ao n\u00famero muito reduzido de pa\u00edses que depositaram a Declara\u00e7\u00e3o do Artigo 34(6) do Protocolo do Tribunal para permitir o acesso directo ao Tribunal Africano a indiv\u00edduos e Organiza\u00e7\u00f5es N\u00e3o Governamentais (ONGs) com estatuto de observador na Comiss\u00e3o de Banjul. Dos 34 pa\u00edses que ratificaram o Protocolo do Tribunal, apenas oito depositaram a declara\u00e7\u00e3o do Artigo 34(6), nomeadamente o Burkina Faso, o Gana, a Guin\u00e9-Bissau, a G\u00e2mbia, o Mali, o Malawi, o N\u00edger e a Tun\u00edsia. E no espa\u00e7o de quatro anos, entre 2016 e 2020, quatro (4) Estados retiraram-se da declara\u00e7\u00e3o do Artigo 34(6), limitando o acesso directo ao Tribunal Africano para indiv\u00edduos e ONGs, nomeadamente o Ruanda, a Tanz\u00e2nia, o Benim e a Costa do Marfim. Isto representa um grande desafio para o mandato do Tribunal Africano e torna cada vez mais dif\u00edcil para as v\u00edtimas de viola\u00e7\u00f5es dos direitos humanos acederem \u00e0 justi\u00e7a e obter repara\u00e7\u00f5es quando n\u00e3o est\u00e3o satisfeitas com os recursos locais. Embora exista um acesso indirecto das ONG ao Tribunal Africano atrav\u00e9s do encaminhamento de casos da Comiss\u00e3o de Banjul para o Tribunal Africano, essa via tem sido limitada em termos de \u00e2mbito e efic\u00e1cia.<\/p>\n<p>No entanto, o cumprimento das decis\u00f5es do Tribunal Africano pelos Estados Partes \u00e9 outro desafio fundamental que n\u00e3o s\u00f3 afecta a efic\u00e1cia do Tribunal, como tamb\u00e9m impede as v\u00edtimas de viola\u00e7\u00f5es dos direitos humanos de obterem repara\u00e7\u00e3o. A aplica\u00e7\u00e3o das decis\u00f5es do Tribunal Africano \u00e9 actualmente inferior a 10%.<\/p>\n<p>Embora continuem a ser envidados esfor\u00e7os por diferentes partes interessadas no sentido de aumentar a efic\u00e1cia do Tribunal Africano, a Coliga\u00e7\u00e3o considera que uma reuni\u00e3o em que participem diversas partes interessadas \u00e9 o f\u00f3rum mais apropriado para trocar ideias e deliberar sobre os pap\u00e9is e estrat\u00e9gias que podem ser adoptados para melhorar o acesso directo ao Tribunal Africano por parte de indiv\u00edduos e ONGs, bem como debater sobre o
