The withdrawal notice dated 3 March 2025 shows it was communicated on 7 March 2025 to the President of the African Union Commission, Office of the AU-Legal Counsel and the African Court. Other State Parties to the African Court Protocol that withdrew Article 34(6) Declaration are Rwanda (2016), Tanzania (2019), and Benin and Cote d\u2019Ivoire (both in 2020).<\/p><p style=\"text-align: justify;\">The African Court Coalition expresses its concern over Tunisia\u2019s decision and the increase of withdrawals of Article 34(6) Declarations as they limit African citizens from directly accessing the African Court on Human and Peoples\u2019 Rights. The African Court is the judicial arm of the African Union and it is members of the African Union that agreed to the establishment of this Court. Although indirect access to the African Court for NGOs exists through referrals of cases from the African Commission on Human and Peoples\u2019 Rights (the Banjul Commission) to the African Court, such avenue has, for a long time now, been limited in scope and efficacy.<\/p><p style=\"text-align: justify;\">After exhaustion of local remedies, citizens have the liberty to access justice beyond domestic mechanisms and they thus need an avenue to address their human rights complaints. The African Court was thus established to protect human and peoples\u2019 rights in Africa primarily through judicial consideration of human rights complaints. It is indeed established under the AU Constitutive Act that one of the objectives of the African Union is to promote and protect human and peoples\u2019 rights in accordance with the African Charter on Human and Peoples\u2019 Rights and other relevant human rights instruments. For States to limit direct access for their citizens by an act of withdrawals of Article 34(6) Declaration; or by not depositing Article 34(6) Declaration, demonstrate that they do not prioritize protection and promotion of human rights in their countries and in Africa by large. A State that respects human rights and follows the rule of law should be in a position to allow its citizens to seek justice beyond domestic borders. \u00a0<\/p><p style=\"text-align: justify;\">It should be noted that to-date, out of 34 State Parties that have ratified the African Court Protocol, only 12 had deposited Article 34(6) Declaration to allow direct access to the African Court for individuals and NGOs, but now after withdrawals from the five States, there remains seven (7) States that allow direct access. These are; Burkina Faso, Ghana, Guinea Bissau, The Gambia, Malawi, Mali and Niger.\u00a0<\/p><p style=\"text-align: justify;\">The African Court Coalition calls for Tunisia to reconsider its withdrawal decision, and we also call upon all African Union Member States that are yet to ratify the African Court Protocol to do so, and those that have ratified but are yet to Deposit Article 34(6) Declaration to also do so to allow direct access for their citizens to the African Court for justice is without borders.<\/p><\/div>\n\t\t\t\t\t\t\t\t\t<div class=\"elementor-tab-title elementor-tab-mobile-title\" aria-selected=\"false\" data-tab=\"2\" role=\"tab\" tabindex=\"-1\" aria-controls=\"elementor-tab-content-1292\" aria-expanded=\"false\">FRENCH VERSION <\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1292\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"2\" role=\"tabpanel\" aria-labelledby=\"elementor-tab-title-1292\" tabindex=\"0\" hidden=\"hidden\"><p style=\"text-align: justify;\">La Tunisie a retir\u00e9 sa d\u00e9claration au titre de l&rsquo;article 34(6) du Protocole de la Cour africaine, devenant ainsi le cinqui\u00e8me \u00c9tat \u00e0 retirer cette d\u00e9claration. L&rsquo;avis de retrait, dat\u00e9 du 3 mars 2025, indique qu&rsquo;il a \u00e9t\u00e9 communiqu\u00e9 le 7 mars 2025 au Pr\u00e9sident de la Commission de l&rsquo;Union africaine, au Bureau du Conseiller juridique de l&rsquo;UA et \u00e0 la Cour africaine. Les autres \u00c9tats parties au Protocole de la Cour africaine qui ont retir\u00e9 leur d\u00e9claration en vertu de l&rsquo;article 34(6) sont le Rwanda (2016), la Tanzanie (2019), ainsi que le B\u00e9nin et la C\u00f4te d&rsquo;Ivoire (tous deux en 2020).<\/p><p style=\"text-align: justify;\">La Coalition pour la Cour africaine exprime son inqui\u00e9tude face \u00e0 la d\u00e9cision de la Tunisie et \u00e0 l&rsquo;augmentation des retraits des d\u00e9clarations de l&rsquo;article 34(6), qui privent les citoyens africains de l&rsquo;acc\u00e8s direct \u00e0 la Cour africaine des droits de l&rsquo;homme et des peuples. La Cour africaine, qui constitue le l&rsquo;organe judiciaire de l&rsquo;Union africaine, a \u00e9t\u00e9 cr\u00e9\u00e9e avec l&rsquo;accord des membres de cette organisation. Bien qu&rsquo;un acc\u00e8s indirect \u00e0 la Cour africaine pour les ONG existe par le biais de renvois d&rsquo;affaires de la Commission africaine des droits de l&rsquo;homme et des peuples (la Commission de Banjul) \u00e0 la Cour africaine, cette voie est, depuis longtemps, limit\u00e9e dans sa port\u00e9e et son efficacit\u00e9.<\/p><p style=\"text-align: justify;\">Apr\u00e8s l&rsquo;\u00e9puisement des recours locaux, les citoyens ont la libert\u00e9 d&rsquo;acc\u00e9der \u00e0 la justice au-del\u00e0 des m\u00e9canismes nationaux et ont donc besoin d&rsquo;une voie pour faire valoir leurs plaintes en mati\u00e8re de droits de l&rsquo;homme. La Cour africaine a donc \u00e9t\u00e9 cr\u00e9\u00e9e pour prot\u00e9ger les droits de l&rsquo;homme et des peuples en Afrique, principalement par le biais de l&rsquo;examen judiciaire des plaintes relatives aux droits de l&rsquo;homme. Il est en effet \u00e9tabli dans l&rsquo;Acte constitutif de l&rsquo;UA que l&rsquo;un des objectifs de l&rsquo;Union africaine est de promouvoir et de prot\u00e9ger les droits de l&rsquo;homme et des peuples conform\u00e9ment \u00e0 la Charte africaine des droits de l&rsquo;homme et des peuples et aux autres instruments pertinents en mati\u00e8re de droits de l&rsquo;homme. Le fait que des \u00c9tats limitent l&rsquo;acc\u00e8s direct de leurs citoyens par un acte de retrait de la d\u00e9claration en vertu de l&rsquo;article 34(6); ou en ne d\u00e9posant pas cette d\u00e9claration, d\u00e9montre qu&rsquo;ils ne donnent pas la priorit\u00e9 \u00e0 la protection et \u00e0 la promotion des droits de l&rsquo;homme dans leurs pays et en Afrique en g\u00e9n\u00e9ral. Un \u00c9tat qui respecte les droits de l&rsquo;homme et se conforme \u00e0 l&rsquo;\u00c9tat de droit devrait \u00eatre en mesure de permettre \u00e0 ses citoyens de rechercher la justice au-del\u00e0 de ses fronti\u00e8res nationales.<\/p><p style=\"text-align: justify;\">Il convient de noter qu&rsquo;\u00e0 ce jour, sur les 34 \u00c9tats parties qui ont ratifi\u00e9 le Protocole de la Cour africaine, seuls 12 ont d\u00e9pos\u00e9 la d\u00e9claration en vertu de l&rsquo;article 34(6) afin d&rsquo;autoriser l&rsquo;acc\u00e8s direct \u00e0 la Cour Africaine pour les particuliers et les ONG, mais maintenant, apr\u00e8s les retraits des cinq \u00c9tats, il ne reste plus que sept (7) \u00c9tats qui autorisent l&rsquo;acc\u00e8s direct. Il s&rsquo;agit du Burkina Faso Ghana, de la Guin\u00e9e-Bissau, de la Gambie, du Malawi, du Mali et du Niger.<\/p><p style=\"text-align: justify;\">La Coalition pour la Cour Africaine appelle la Tunisie \u00e0 reconsid\u00e9rer sa d\u00e9cision de retrait, et nous appelons \u00e9galement tous les Etats membres de l&rsquo;Union Africaine qui n&rsquo;ont pas encore ratifi\u00e9 le Protocole de la Cour Africaine \u00e0 le faire, et ceux qui l&rsquo;ont ratifi\u00e9 mais qui n&rsquo;ont pas encore d\u00e9pos\u00e9 la D\u00e9claration de l&rsquo;Article 34(6) \u00e0 le faire \u00e9galement pour permettre l&rsquo;acc\u00e8s direct de leurs citoyens \u00e0 la Cour Africaine, car la justice est sans fronti\u00e8res.<\/p><\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>ENGLISH VERSION FRENCH VERSION ENGLISH VERSION Tunisia has withdrawn its Declaration under Article 34(6) of the African Court Protocol, becoming the fifth State to withdraw the Declaration.
