The primary conclusion of this convening was that the African human rights system stands at a critical crossroads where past jurisprudential successes are being threatened by a growing culture of limited access, State non-compliance and other technical bottlenecks. To safeguard the Court\u2019s future, the Coalition has adopted \u2018The Arusha Roadmap\u2019 Outcome document. This outcome document serves as a strategic framework for development of concrete initiatives aimed at enhancing the Court\u2019s effectiveness and relevance within a rapidly evolving technological landscape, ensuring it remains a steadfast pillar of justice for all African citizens. The below recommendations apply to a diverse group of stakeholders including the Coalition itself, the African Court, State actors, CSOs, Academia, litigants, NHRIs, the African Union and all other key stakeholders.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-089eeb5 e-con-full e-flex e-con e-parent\" data-id=\"089eeb5\" data-element_type=\"container\">\r\n\t\t\t\t<div class=\"elementor-element elementor-element-cb5e4cb elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"cb5e4cb\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"text-align: justify;\"><span style=\"color: #004201;\"><strong>I: DISMANTLING SYSTEMIC BARRIERS TO JUDICIAL ACCESS<\/strong><\/span><\/p><ol style=\"text-align: justify;\"><li style=\"text-align: justify;\">Operationalize the \u2018Banjul-to-Arusha Bridge\u2019\u00a0by pressuring for immediate operationalization of the 2025 Commission-Court Referral Guidelines to reinforce the complementarity envisaged by the African Court Protocol and reduce the bottleneck created the limited number of Article 34(6) Declarations.<\/li><li style=\"text-align: justify;\">Decrease the 60% African Court\u2019s cases inadmissibility rate\u00a0through intensive technical training for CSOs and practitioners on admissibility requirements and the\u00a0exhaustion of local remedies.<\/li><li style=\"text-align: justify;\">Execute the \u2018Gambia Model\u2019 for Bar Associations\u00a0by establishing specialized subcommittees within every national Bar to monitor, report, and lead high-level political lobbying for Protocol ratification and Article 34(6) deposits.<\/li><li style=\"text-align: justify;\">Target \u2018progressive administrations\u2019\u00a0through a strategic mapping of States with recent leadership changes to coordinate high-level advocacy missions.<\/li><li style=\"text-align: justify;\">Adopt the \u2018constructive exhaustion\u2019 doctrine\u00a0by litigating cases that challenge the Court to waive exhaustion requirements when domestic remedies are proven to be systemically biased or where State non-compliance makes local recourse illusory.<\/li><li style=\"text-align: justify;\">Pilot preliminary rulings\u00a0to allow national high courts to request direct interpretive guidance from the African Court on human rights treaties, creating a judicial shortcut that bypasses executive bottlenecks.<\/li><\/ol><p style=\"text-align: justify;\"><span style=\"color: #004201;\"><strong>II. ENFORCING COMPLIANCE AND <\/strong><\/span><span style=\"color: #004201;\"><strong>SOVEREIGN ACCOUNTABILITY<\/strong><\/span><\/p><p style=\"text-align: justify;\">7. Mandate Public Compliance Hearings within twelve months of every merit decision, following the Children\u2019s Rights Committee model to scrutinize State progress and ensure non-execution remains in the political spotlight.<\/p><p style=\"text-align: justify;\">8. Develop \u2018regional contempt of Court\u2019 Jurisprudence to move beyond finding simple violations toward issuing punitive financial interests and coercive sanctions against persistently defiant Member States and specific office-holders.<\/p><p style=\"text-align: justify;\">9. Supporting finalisation of the PAP Model Law on Implementation to help national parliaments create mechanisms for the automatic enforcement of reparations.<\/p><p style=\"text-align: justify;\">10. Support the refinery of the \u2018survivor clause\u2019 in national legislation to ensure that domestication laws are drafted to remain applicable and enforceable even in the absence of a constitution or during periods of military\/transitional rule.<\/p><p style=\"text-align: justify;\">11. Advocate for institutionalization and financing of National Focal Points through national legal frameworks integration with dedicated, ring-fenced budget lines that facilitate monitoring and implementation missions.<\/p><p style=\"text-align: justify;\">12. Hardwire automatic enforceability (in States where it is not automatic) by advocating for amendment of relevant legislations to ensure regional judgments are categorized as directly executable or enact frameworks to ensure regional judgements can be enforced through national (apex) courts.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-16cd377 elementor-widget elementor-widget-text-editor\" data-id=\"16cd377\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p style=\"text-align: justify;\"><span style=\"color: #004201;\"><strong>III. PIONEERING NEW FRONTIERS AND STRATEGIC LITIGATION<\/strong><\/span><\/p><p style=\"text-align: justify;\">13. Strengthen coalition-based strategic litigation at the African Court on emerging and high impact human rights issues.<\/p><p style=\"text-align: justify;\">14. Execute the \u2018Justice Pincer\u2019 Strategy to tackle the nexus of human rights and corruption, by holding accountable at the African Court, States that fail to regulate non-state actors.<\/p><p style=\"text-align: justify;\">15. Forge partnerships with NHRIs\u00a0to utilize their\u00a0subpoena and investigative powers\u00a0to build technically superior evidentiary records that make violations unavoidable for judges.<\/p><p style=\"text-align: justify;\">16. Combat State-led internet shutdowns by launching strategic litigation using the continental economic loss argument to move governments beyond human rights rhetoric toward practical accountability.<\/p><p style=\"text-align: justify;\">17. Modernization of digital evidentiary standards in the Court\u2019s Rules of Procedure to allow for the admission of authenticated metadata, geolocation, and timestamps to address online harassment and State-led surveillance.<\/p><p style=\"text-align: justify;\">18. Adopt the \u20183 C\u2019s\u2019 and \u2018lowest hanging fruit\u2019 Strategy for case selection, focusing on Causality, Consistency, and Client-centered cases against the most compliant respondent States to secure transferable landmark results.<\/p><p style=\"text-align: justify;\"><span style=\"color: #004201;\"><strong>IV. JURISPRUDENTIAL IDENTITY, GENDER, AND INCLUSIVITY<\/strong><\/span><\/p><p style=\"text-align: justify;\">19. Encourage the development of authentic African Jurisprudenceby deliberately integrating indigenous philosophies such as Ubuntu into judicial reasoning to enhance the Court\u2019s cultural legitimacy and continental resonance.<\/p><p style=\"text-align: justify;\">20. Institutionalize a mandatory gender lens by applying genderized reasoning to all applications from the onset and implementing trauma-informed protocols to prevent the revictimization of survivors.<\/p><p style=\"text-align: justify;\">21. Scale the feminist judgments model and increase the representation of women on the legal aid roster to ensure regional jurisprudence is contextualized through the lived experiences of African women.<\/p><p style=\"text-align: justify;\">22. Uphold the \u2018social model\u2019 of disability in expert testimony to highlight systemic barriers and demand reasonable courtroom accommodation (including sign language) as a fundamental procedural right.<\/p><p style=\"text-align: justify;\">23. Streamline adjudication via \u2018human-in-the-loop\u2019 AI to reduce judgment drafting time while utilizing Practice Directions 9 and 35B to allow for digital filing (WhatsApp\/Email) for remote defenders\/litigants.<\/p><p style=\"text-align: justify;\">25. Support the African Court Implementation Database to reduce the current information gap on State compliance.<\/p><p style=\"text-align: justify;\">26. Democratize Justice via \u2018architects of visibility\u2019 by lobbying to bridge the communication budget gap and utilizing hyper-local community radio to reach the indigenous communities in local languages.<\/p><p style=\"text-align: justify;\">27. Secure judicial quality via the Arusha Initiative and monitor judicial vacancy cycles to ensure a bench defined by proven human rights competence as required by the African Court Protocol.<\/p><p style=\"text-align: justify;\">29. Operationalize the transitional Court of Justice and launch a diplomatic campaign to secure the final seven ratifications of the entry into force of the Sharm El-Sheikh Protocol for the merged Court.<\/p><p style=\"text-align: justify;\">30.
