On Tuesday 12 November 2024, after the opening of its 75th<\/sup> Ordinary Session, the African Court on Human and Peoples\u2019 Rights will hold a Compliance Hearing in Application No 006\/2012-\u00a0African Commission on Human and People\u2019s Rights<\/em>\u00a0v\u00a0Republic of Kenya, <\/em>famously known as the Ogiek Case. The compliance hearing will be open for the public to attend.<\/p>

The Ogiek people are the indigenous community in Kenya who have depended on the Mau Forest in Kenya for their residence and as a source of livelihood for centuries. However, in 2009 the Kenya Forestry Service ordered the eviction of the Ogiek community from the Mau Forest. Subsequently, the Centre for Minority Rights Developments (CEMIRIDE) and Minority Rights Group International (MRGI), two NGOs acting on behalf of the Ogiek community submitted a complaint to the African Commission on Human and Peoples\u2019 Rights (the Banjul Commission) which was then transferred to the African Court on Human and Peoples\u2019 Rights in 2012. In its 2022 judgement, among other things, the African Court ordered recognition of the Ogiek as an indigenous people; it also ordered the Kenyan government to immediately reinstate the restrictions imposed on land transactions in the Mau Forest complex as a provisional measure. The 75th<\/sup>\u00a0Ordinary Session of the Court which will run from 11 November to 6 December 2024, will also include a series of other events.<\/p>

On Wednesday 13 November 2024, the Court will deliver judgments in the following ten (10) cases:<\/p>

  2. Application No. 015\/2018, Kija Nestory Jinyamu v. United Republic of Tanzania<\/a><\/li>

  4. Application No. 024\/2018, Gerald Koloso Kalonge v United Republic of Tanzania<\/a><\/li>
  5. Application No. 027\/2018, Lamek Bazil v United Republic of Tanzania<\/a><\/li>
  6. Application No. 030\/2018, Edison Simon Mwombeki v United Republic of Tanzania<\/a><\/li>
  7. Application No. 029\/2019, Moussa Doumbia v. Republic of C\u00f4te d\u2019Ivoire<\/a><\/li>

    Both the Compliance Hearing on the Ogiek Case and delivery of judgments will commence at 10:00am (East African Time) and will be accessible via live streaming in both English and French. For the Public Hearing, simultaneous interpretation will be available in Arabic, English, French and Kiswahili.<\/p>

    On Thursday 14 November 2024, the Court will sign a Memorandum of Understanding (MoU) with the Centre for the Study of Violence and Reconciliation (CSVR).<\/p>

    The Court will also consider eight (8) applications and deal with a number of administrative matters.<\/p>

    Le mardi 12 novembre 2024, apr\u00e8s l’ouverture de sa 75e session ordinaire, la Cour africaine des droits de l’homme et des peuples tiendra une audience de conformit\u00e9 dans la requ\u00eate n\u00b0 006\/2012- Commission africaine des droits de l’homme et des peuples c. R\u00e9publique du Kenya<\/em>, connue sous le nom affaire Ogiek. L \u2018audience de conformit\u00e9 sera ouverte au public.<\/p>

    Le peuple Ogiek est une communaut\u00e9 autochtone du Kenya qui d\u00e9pend depuis des si\u00e8cles de la for\u00eat Mau au Kenya pour y vivre et en tire ses moyens de subsistance. Cependant, en 2009, le Service forestier du Kenya a ordonn\u00e9 l’expulsion de la communaut\u00e9 Ogiek de la for\u00eat Mau. Par la suite, le Centre for Minority Rights Developments (CEMIRIDE) et Minority Rights Group International (MRGI), deux ONG agissant au nom de la communaut\u00e9 Ogiek, ont d\u00e9pos\u00e9 une plainte aupr\u00e8s de la Commission africaine des droits de l’homme et des peuples (la Commission de Banjul), qui a ensuite \u00e9t\u00e9 transf\u00e9r\u00e9e \u00e0 la Cour africaine des droits de l’homme et des peuples en 2012.       L’audience de conformit\u00e9 dans l’affaire Ogiek et le prononc\u00e9 des arr\u00eats commenceront \u00e0 10h00 (heure d’Afrique de l’Est) et seront accessibles en direct en anglais et en fran\u00e7ais. Pour l’audience publique, l’interpr\u00e9tation simultan\u00e9e sera disponible en anglais, arabe, fran\u00e7ais et kiswahili.<\/p>

      Le jeudi 14 novembre 2024, la Cour signera un protocole d’accord avec le Centre d’\u00e9tude de la violence et de la r\u00e9conciliation (CSVR).<\/p>
