THE AFRICAN COURT COALITION MISSION IN TANZANIA SECURES KEY COMMITMENTS TOWARDS ENHANCING IMPLEMENTATION OF THE AFRICAN COURT DECISIONS

A delegation from the African Court Coalition which included representation from the East Africa Law Society (EALS) concluded a successful mission in Dodoma, Tanzania, securing key commitments that are vital towards enhancing implementation of decisions of the African Court on Human and Peoples’ Rights (the African Court) and regional human rights decisions in general. The delegation held constructive meetings with the Ministry of Constitutional and Legal Affairs (MoCLA) and the Commission for Human Rights and Good Governance (CHRAGG) from 10 to 11 July 2025 in Dodoma, Tanzania, marking a pivotal moment in revitalizing cooperation with State actors and the national human rights institution.
Engagement with the Tanzania Ministry of Constitutional and Legal Affairs
In an in-depth and constructive engagement, the Coalition delegation and senior officials from the Tanzania Ministry of Constitutional and Legal Affairs conversed about practical pathways towards Tanzania’s compliance with its human rights obligations and more specifically compliance with decisions rendered by the African Court and the East African Court of Justice. The Ministry demonstrated a clear commitment in working towards enhancing coordination that will result in several significant outcomes:
- The establishment of an institutionalized implementation focal point:the Ministry acknowledged the need for better coordination and dedicated personnel when it comes to implementation of regional human rights decisions and informed the Coalition delegation that plans are already underway and the expectation is that the government will allocate the budget needed in the immediate financial year to put such plans into actions.
- Commitment to Internal Dialogue:The delegation from the Ministry also affirmed it will initiate consultations with other relevant government organs to streamline the process of implementation of regional human rights decisions.
- Formalizing Cooperations and Collaborations:The Ministry positively received a proposal from the Coalition delegation on the need to sign a Memorandum of Understanding (MoU) with the Coalition that will structure future cooperations and collaborations, information sharing, and technical support. It was agreed that the Ministry delegation will advance the talks on this proposal internally.
One of the key challenges that was identified during the talks was the lack of a national implementation framework in Tanzania that provides clear guidance on the process of implementation of decisions of the African Court and other regional human rights decisions. In line with this, delegates from each side agreed on the need to continue with further engagements and information sharing on good practices from other systems and countries in the efforts to enhance implementation of regional human rights decisions.
Engagement with the Commission for Human Rights and Good Governance (CHRAGG)
The meeting with CHRAGG revealed an exceptionally high level of readiness and proactive commitment. The Commission, whose mandate includes monitoring the implementation of regional judgments, has already undertaken significant preparatory work, including developing an internal database of decisions of the African Court. The meeting resulted in a robust roadmap for joint action:
- Immediate Formalization of Partnership:CHRAGG strongly championed the signing of an MoU with the Coalition to formalize the partnership on cooperations and collaborations.
- Targeted Capacity Building:among the key priority areas, the Commission identified the need for specialized training on implementation of regional human rights decisions to enhance monitoring and reporting of such decisions.
The Coalition is grateful to the Tanzania Ministry of Constitutional and Legal Affairs and the Commission for Human Rights and Good governance for this successful mission and the key commitments made for continued cooperation and collaborations towards enhancing implementation of regional human rights decisions. The key commitments especially from the government demonstrates Tanzania’s readiness and political will to respect and comply with regional human rights decisions.

Une délégation de la Coalition pour la Cour africaine, comprenant des représentants de East Africa Law Societ, a effectué avec succès une mission à Dodoma, en Tanzanie, obtenant des engagements clés qui sont essentiels pour renforcer la mise en œuvre des décisions de la Cour africaine des droits de l’homme et des peuples (la Cour africaine) et des décisions régionales en matière de droits de l’homme en général. La délégation a tenu des réunions constructives avec le Ministère des Affaires Constitutionnelles et Juridiques et la Commission des Droits de l’Homme et de la Bonne Gouvernance les 10 et 11 juillet 2025 à Dodoma, Tanzanie, marquant un moment charnière dans la revitalisation de la coopération avec les acteurs étatiques et l’institution nationale des droits de l’homme.
Dialogue avec le Ministère des Affaires Constitutionnelles et Juridiques de Tanzanie
Au cours d’un dialogue approfondi et constructif, la délégation de la Coalition et de hauts fonctionnaires du Ministère des Affaires Constitutionnelles et Juridiques de Tanzanie ont discuté des voies pratiques permettant à la Tanzanie de se conformer à ses obligations en matière de droits de l’homme et, plus spécifiquement, du respect des décisions rendues par la Cour africaine et la Cour de Justice de l’Afrique de l’Est. Le Ministère a manifesté un engagement clair à œuvrer pour le renforcement de la coordination, ce qui aboutira à plusieurs résultats significatifs :
- La création d’un point focal institutionnel pour la mise en œuvre : le Ministère a reconnu la nécessité d’une meilleure coordination et d’un personnel dédié en ce qui concerne la mise en œuvre des décisions régionales en matière de droits de l’homme. Il a informé la délégation de la Coalition que des plans sont déjà en cours et que le gouvernement devrait allouer le budget nécessaire au cours du prochain exercice financier pour concrétiser ces plans.
- Engagement en faveur d’un dialogue interne :La délégation du Ministère a également affirmé qu’elle entamerait des consultations avec d’autres organes gouvernementaux compétents afin de rationaliser le processus de mise en œuvre des décisions régionales en matière de droits de l’homme.
- Formalisation de la coopération et des collaborations :Le Ministère a accueilli favorablement une proposition de la délégation de la Coalition sur la nécessité de signer un Protocole d’Accord avec la Coalition qui structurera les coopérations et collaborations futures, le partage d’informations et le soutien technique. Il a été convenu que la délégation du Ministère fera avancer les discussions sur cette proposition en interne.
L’un des principaux défis identifiés lors des discussions a été l’absence d’un cadre national de mise en œuvre en Tanzanie fournissant des orientations claires sur le processus d’application des décisions de la Cour africaine et d’autres décisions régionales en matière de droits de l’homme. Dans ce contexte, les délégués de chaque partie ont convenu de la nécessité de poursuivre les échanges et le partage d’informations sur les bonnes pratiques d’autres systèmes et pays dans le but de renforcer la mise en œuvre des décisions régionales en matière de droits de l’homme.
Dialogue avec la commission des droits de l’homme et de la bonne gouvernance
La réunion avec la commission des droits de l’homme et de la bonne gouvernance a révélé un niveau exceptionnellement élevé de préparation et d’engagement proactif. La Commission, dont le mandat inclut le suivi de la mise en œuvre des jugements régionaux, a déjà entrepris un important travail préparatoire, notamment en développant une base de données interne des décisions de la Cour africaine. La réunion a abouti à une feuille de route solide pour une action commune :
- Formalisation immédiate du partenariat :La commission a fermement soutenu la signature d’un Protocole d’Accord avec la Coalition pour formaliser le partenariat en matière de coopération et de collaboration.
- Renforcement ciblé des capacités :parmi les domaines prioritaires clés, la Commission a identifié le besoin d’une formation spécialisée sur la mise en œuvre des décisions régionales en matière de droits de l’homme afin d’améliorer le suivi et le rapportage de ces décisions.
La Coalition est reconnaissante envers le Ministère des Affaires Constitutionnelles et Juridiques de Tanzanie et la Commission des Droits de l’Homme et de la Bonne Gouvernance pour le succès de cette mission et les engagements clés pris pour une coopération et des collaborations continues en vue de renforcer la mise en œuvre des décisions régionales en matière de droits de l’homme. Ces engagements clés, en particulier de la part du gouvernement, démontrent la disposition et la volonté politique de la Tanzanie à respecter et à se conformer aux décisions régionales en matière de droits de l’homme.
